What is it?

A planning proposal is a report that explains the intended effect of, and justification for, a proposed amendment to a Local Environmental Plan (LEP). An LEP is comprised of a written planning instrument and supporting maps, that allows Council to manage development outcomes.

The Rockdale Local Environmental Plan 2011 (RLEP 2011), Botany Bay Local Environmental Plan 2013 (BBLEP 2013) and Botany Local Environmental Plan 1995 (BLEP 1995) are the primary planning instruments that govern land use planning decisions within the Bayside LGA.

Other NSW State planning Acts, regulations and planning policies require consideration when preparing a Planning Proposal, and these can be found on the NSW Legislation website. These include, but are not limited to:

  • NSW Environmental Planning and Assessment Act 1979 (EP&A Act, 1979)
  • NSW Environmental Planning and Assessment Regulation 2000 (EP&A Regs 2000)
  • NSW Local Government Act 1993
  • State Environmental Planning Policies (SEPPs)
  • Section 117 Ministerial Directions

What do I need to do?

When preparing a planning proposal consideration should also be given to the Rockdale Development Control Plan 2011 (RDCP 2011) or Botany Bay Development Control Plan 2013 (BBDCP 2013), Council’s Section 94 Contributions Plans and Council’s Technical Specifications, to determine whether the planning outcomes being pursued by the proponent are likely to be achievable in a subsequent Development Application.

Council’s Voluntary Planning Agreements policy is to be adhered to where a proponent seeks a Voluntary Planning Agreement (VPA) to support a planning proposal. The policy outlines Council’s expectations for the use of VPAs, and the procedures relating to matters including their preparation, negotiation, exhibition and application.
