Infrastructure Contributions

Infrastructure contributions help address the needs of the growing population in the Bayside area.

What are they?

The population in Bayside is growing. In 2016 Bayside's population was 169,900, by 2036 it is forecast to be around 228,200 an increase of 40% or 65,300 more people. This will mean new or expanded Council facilities and services will be needed.

Under the Environmental and Planning Assessment Act (EP&A Act), Councils in NSW have the ability to levy developers for contributions towards increasing the capcity of existing infrastructure or providing new facilities.  The contributions plans, known as section 7.11 (formerly section 94) or section 7.12 (formerly section 94A) contributions, spell out how Council will assess, collect, spend and administer developer contributions.

The contributions plans also describe anticipated development, the infrastructure needed to accompany a new development and the contribution to be paid by a developer towards these infrastructure costs. Examples of infrastructure that can be funded by developer contributions include new or upgraded amenities, open space, community facilities and transport infrastructure amongst others.

There are two types of contribution plans;

Section 7.11 Plans (formerly section 94 of the Environmental Planning and Assessment Act). These contributions are typically levied on new residential and employment generating developments, including;

  • New dwellings (where the new dwelling does not propose to replace the existing dwelling)
  • Secondary dwellings/granny flats
  • Residential flat buildings
  • Subdivision

Section 7.12 Plans (formerly section 94A of the Environmental Planning and Assessment Act), are applicable where the construction cost is more than $100,000 and where section 7.11 contributions are not required. Section 7.12 contributions are a fixed levy based on a percentage of the cost of the development. These contributions are typically applied to alterations and additions, including;

  • Garages and sheds
  • Demolition of an existing house and construction of a new house

What's being done?

Bayside Council has a number of contributions plans in place across the city to support the provision of the following facilities and services:

  • Open space
  • Community services and facilities
  • Public car parking within certain town centres
  • Town centre and streetscape improvements
  • Pollution control
  • Road and traffic management 
  • Pedestrian and cyclist infrastructure
  • Flood mitigation and stormwater management
  • The costs of managing and administering the contributions plan

Infrastructure contribution rates for financial year 2021/2022

Contribution rates vary according to the location of the infrastructure and the nature of the works proposed. The different contribution precincts are mapped in the contribution plans listed below.

Contribution rates are adjusted each year using a process as described in the different contribution plans, using Australian Bureau of Statistics indexes and land valuations.

Under Section 217 of Environmental Planning and Assessment Regulation 2021 and following Planning Circular PS 21-002, Bayside Council publishes information on infrastructure contributions levied on residential and work creation developments, and plans with construction costs of more than $100,000. Contributions must be published monthly from 1 July 2022 as a condition of approved development applications or complying development certificates, to improve transparency and accountability in collected infrastructure contributions.

Which ones currently apply?

There are currently seven development contributions plans which apply to the Bayside area. The plans are from the former City of Botany and Rockdale City Council areas and are made up of five 7.11 (formerly s94 of the EP&A Act) Plans and two s7.12 (formerly s94a of the EP&A Act) Plans.
